State Authorization, Student Complaints & Professional Licensure

State Authorization

State Authorization is a legal issue dealing with a college’s adherence to state requirements for colleges to secure authorization to offer instruction in that state. Institutions offering distance education courses or programs must provide current and prospective students with the contact information for filing complaints with the college, its accrediting agency, and with the state agencies that handle complaints in the students’ state of residence.

The State Authorization Federal Regulation Chapter 34, ß 600.9(c)
If an institution is offering postsecondary education through distance or correspondence education to students in a State in which it is not physically located or in which it is otherwise subject to State jurisdiction as determined by the State, the institution must meet any State requirements for it to be legally offering distance or correspondence education in that State. An institution must be able to document to the Secretary the State’s approval upon request.

States in Which COA Serves Distance Learning Students

States regulate which institutions can offer education to its citizens. College of The Albemarle (COA) must comply with the state regulation requirement based on the Higher Education Opportunity Act of 2008. To meet this requirement, COA has joined NC-SARA to serve students in states outside of North Carolina.

California is not part of NC-SARA. As an out-of-state public institution, COA is not under the purview of the California Bureau of Private Postsecondary Education.

Filing a Grievance/Complaint

College of the Albemarle strives to serve all students, faculty and staff in a manner that is respectful and supportive. Students are encouraged to seek an informal resolution by contacting the involved parties. In the event that this option does not bring resolution, students may contact the Vice President for Student Success and Enrollment Management (SSEM) via completion of an Incident Report form.

Please submit grievances/complaints via the Incident Report form.

If the grievance/complaint cannot be resolved at the institutional level, students may file a complaint with the North Carolina Post-Secondary Education Complaints unit.

To file a complaint concerning a postsecondary institution offering degree programs in North Carolina, read the complaint policy and print out and complete the Student Complaint Form (PDF) and submit the complaint to:

SACSCOC Student Complaint Process

The Southern Association of Colleges and Schools Commission on Colleges (SACSCOC) expects individuals to attempt to resolve complaints against COA through all means available to the complainant, including following the college’s own procedures, before submitting a complaint to the Commission. Therefore, the Commission’s usual practice is to not consider a complaint that is currently in administrative proceedings, institutional proceedings or litigation. However, if there’s substantial, credible evidence that indicates systemic problems with an accredited institution, the Commission may, at its discretion, choose to proceed with the review.

In order to be considered, a formal complaint must be submitted in writing using the Commission’s Complaint Policy and Form. Please mail two signed copies to:

  • Not in writing
  • Sent on behalf of another individual or forwarded to the Commission
